According to the law on "Property purchase by foreigners in Turkey" enacted in January 7, 2006, foreign nationals (real persons) are able to acquire real estate in Turkey on the conditions of being reciprocal and complying with legal restrictions. In implemenation of the reciprocity principle, it is essential that real estate acquisation rights given by a foreign country to its own citizens and to commercial companies established in foreign countries according to the laws of these countries are also given to the citizens and commercial companies of the Republic of Turkey.

 

If you have decided to purchase a property the next step is to sign a legal sales contract with the owner or an agent. After signing the contract, where all matters referring the sale of that property should be settled, you have to get the official ownership paper, called Tapu (deed). In case that you pay in rates usually you get your Tapu when you have paid the last payment rate. In order to get the Tapu (deed), you have to apply at the respective Tapu (deed) office in Alanya, where you need some documents as following:
Title Deed or a document indicating the property's exact location (plot or parcel number etc.)
Passport and/or ID Card of the buyer - two recent passport photos of the buyer, sized 4 cm x 6 cm.


Power of Attorney There are several steps to be followed in buying a property. That's why it is suggested to appoint someone or an agent to deal with all necessary transactions by means of a legal document called "Power of Attorney" for buying property. This should be done in the presence of a Notary-Public. A Principal (the person who delegates his authority) can give an Agent broad legal authority, or very limited authority.The Power of Attorney is frequently used to help in the event of a Principal's illness or disability or in legal transactions where the principal can not be present to sign necessary legal documents.

Under what conditions and how long a Power of Attorney shall be in force and end should be clearly defined. A Power of Attorney can be used to make an Agent, buy, sell or rent out your property, manage your property, conduct your banking transactions, invest or make use of your money on behalf of you, make legal claims and conduct litigation or, carry out tax matters: the conditions such as the duration of validity, actions that the agent can take and not take etc. should be stated clearly in those documents.

Selling Property in Turkey Capital gains made from the sale of a property will be taxable in Turkey if the owner is a company. Individuals don't have to pay any capital gains, provided they have owned the property for more than four years. Residents Visas Depending on your citizenship you are allowed to stay in Turkey 1 to 3 month. If you want to stay longer, you should apply for a long-term residents at the police. Visa and living permission

Turkish embassy in your home country. If you are going to stay for a longer period in Turkey, you
need to apply for living permission. This you can apply at the foreign police in Alanya. The
living permission must be picked up personally at the police station.

Foreigners from some countries also need living permission to be able to buy apartments.
